A justice of the Superior Court allowed a Motion to Enforce a Settlement Agreement filed on behalf of the Defendants by Attorneys Nancy Frankel Pelletier
Jeffrey Trapani. The Defendants, owners of rental property, had been sued by their tenant for injuries the tenant alleged were the result of an unnatural accumulation of snow and ice.
After the suit was filed, counsel for the parties negotiated a settlement whereby the tenant’s counsel accepted a monetary offer from the Defendants’ counsel. After not responding to the Defendants request for a release, the tenant’s counsel stated that his client had changed her mind.
In their motion, Attorneys Pelletier and Trapani argued that the oral agreement reached between counsel for the parties formed an enforceable contract that was binding on both parties. The Superior Court agreed and ordered the tenant to execute the release for the agreed upon settlement amount.
