Robinson Donovan Attorneys Nancy Frankel Pelletier and David S. Lawless obtained summary judgment in a lawsuit brought by the Town of Seekonk’s former superintendent of public works. The plaintiff brought suit because his appointment had been rescinded by Seekonk’s Board of Selectmen after the United States Court of Appeals for the First Circuit upheld a jury verdict finding that the plaintiff had violated the equal protection rights of a local developer. The Town also refused to indemnify the plaintiff for punitive damages awarded in that matter. Attorneys Frankel Pelletier and Lawless successfully argued that the Town was justified in terminating the plaintiff’s employment and that it was legally barred from paying the damages awarded in the federal case. Following oral argument, the Superior Court ruled in favor of the Town on each of seven constitutional, statutory and contract-based claims.
