Attorneys Pelletier and Lawless Successfully Defended the City of Westfield

Attorneys Nancy Frankel Pelletier and David S. Lawless successfully defended the City of Westfield in a series of suits spanning two decades, brought in both state and federal courts, challenging the enforceability of a construction deadline relating to a condominium project permitted in the mid eighties. The state case, which began as an enforcement action brought by the City in 2001, was decided in the City's favor on cross motions for summary judgment in the Housing Court. The Appeals Court rejected the plaintiffs' appeal and the Supreme Judicial Court recently denied further appellate review. Previously, Attorney Pelletier had defeated the same plaintiffs' efforts to pursue a suit in Federal court alleging violations of constitutional rights.
