Attorney Nancy Frankel Pelletier and Attorney David S. Lawless obtained Summary Judgment in favor of their clients in a Federal Civil Rights action.
The suit stemmed from a raid on a family home of a known medical marijuana activist, led by the Hamden County Drug Task Force. The Holland police department had received information which indicated that drugs were being sold out of the home. The Chief contacted the drug task force who led an investigation, including three controlled buys, which ultimately resulted in the raid at which the Chief and at least one of his officers were present.
The 10 plaintiffs alleged claims including false arrest and violations of the First, Fourth, and Fourteenth Amendments to the US Constitution. United States District Court Judge Michael Ponser entered Judgment in favor of the Chief and his officer on all claims and all counts.
