Attorney Nancy Frankel Pelletier successfully argued a Motion to Dismiss a Federal Civil Rights claim against the Town of West Stockbridge and members of its Zoning Board of Appeals before United States District Court Judge Michael Ponser.
Judge Ponser ordered that judgment enter for all defendants on the federal claims agreeing with the argument proffered that no violation of substantive due process could be found on the facts alleged by the plaintiff. The plaintiff alleged wrongdoing on the part of the defendants in upholding a cease and desist order issued by the building inspection in connection with the plaintiff's quarrying operations.
