Massachusetts Appeals Court Upheld Decision Received by Nancy Frankel Pelletier

The Massachusetts Appeals Court recently upheld the favorable decision received by Attorney Nancy Frankel Pelletier in favor of the City of Northampton in a wrongful death case. The plaintiff brought suit against the City on behalf of her mother who was killed in an early morning motor vehicle accident on icy roads in the City. Ms. Pelletier successfully argued that the discretionary function exception to M.G.L. c. 258, precluded the imposition of liability.
