Attorneys Martin & Lawless Receive Jury Verdicts in Complex Discrimination Case and Preliminary Injunction for Local Business

On Tuesday, April 10, 2007, Robinson Donovan Business Department Chair, James F. Martin, assisted by Associate David S. Lawless, received a jury verdict in favor of a local business in a complex four count employment discrimination case. After five days of trial in Hampden County Superior Court which involved the testimony of numerous witnesses, the jury returned a verdict in favor of Robinson Donovan’s client in only 20 minutes.

On the same day that Attorney Martin received the successful jury verdict, he also successfully argued that the Superior Court should grant a preliminary injunction in favor of a local business. Attorney Martin argued, and the court agreed, that disparaging the viability of a competitor’s business by making false and defamatory statements about that business is an unfair method of competition which is prohibited by the Massachusetts Consumer Protection Act, M.G.L. chapter 93A. The injunction, in a case that is still pending, rests on a finding that Attorney Martin’s client is likely to succeed on the merits of its case and orders the defendant to refrain from disparaging its competitor’s business.
